If your child was injured in a crash in Memphis, you can file a claim on your child's behalf to seek compensation for their injuries. As a parent or guardian, you can pursue this claim while your child is still a minor.
Because Tennessee is an at-fault state, the driver responsible for the crash is generally liable through their insurance. Your health insurance or medical payments coverage may also help cover your child's medical expenses while you wait for the claim to be resolved.
Depending on your child's injuries, you may seek compensation for medical bills, future treatment, and pain and suffering. You may also be able to recover money you have already spent on your child's medical care, depending on the circumstances of the case.
For claims involving minors, Tennessee courts must approve certain settlements, including those worth $10,000 or more. This helps ensure that the settlement is fair to your child and that the money is properly managed for their benefit.
In Tennessee, most personal injury claims must be filed within one year of the crash, which is shorter than in many other states. However, different deadlines may apply to your child's claim, so it is best to understand your options early.
If the insurance company questions the extent of your child’s injuries, a car accident lawyer in Tennessee can gather medical records and other evidence to show how the injuries have affected your child. An attorney can also handle the court approval and paperwork, so you don't have to manage it on your own.
