In Warren County and throughout Tennessee, families generally have one year from the date of their loved one’s death to file a wrongful death lawsuit in Tennessee. This one-year period applies to most wrongful death cases, including those arising from fatal car crashes.
Under Tennessee law, the surviving spouse generally has the first right to file a wrongful death claim. If there is no spouse, the children or other next of kin may file. The estate’s personal representative may also bring the claim.
Depending on your family’s losses, a wrongful death claim may cover funeral expenses, medical bills from before your loved one’s death, and income they would have earned. You may seek damages for the loss of their love, care, and companionship.
To support your family’s claim, gather the police report, death certificate, medical and funeral bills, and proof of your loved one’s income. Keeping these documents can make it easier to explain your family’s losses and help the claim move forward.
If the one-year deadline is missed, your family may lose the chance to seek compensation through the courts. This is why it is important to take action before the deadline.
If an insurer offers less than your family’s losses may be worth, a wrongful death lawyer in Tennessee can gather evidence to show the full impact of your loss. An attorney can also handle the paperwork and deadlines as the claim moves forward.
