When a motorcycle crash results in a death, eligible surviving family members may have legal options for seeking compensation, depending on the circumstances and Tennessee law. These claims may help address financial losses associated with the death and other damages recognized by law.
In Tennessee, a wrongful death claim may be brought by a person authorized under state law, often a surviving spouse or another eligible family member.
The claim generally must establish that another party’s wrongful act or negligence caused the death. Investigators’ findings, witness accounts, vehicle damage, and other available evidence may help determine how the crash occurred and whether another party may be legally responsible.
Potential compensation may include qualifying medical expenses incurred before death, funeral and burial costs, lost income or financial support, and other damages permitted under Tennessee law. The types of damages available depend on the facts of the case, the relationship to the deceased, and applicable legal requirements. Compensation is not guaranteed, and liability must be established.
Preserving evidence can be an important part of evaluating a potential claim. Relevant materials may include the official crash report, photographs, witness information, medical records, and insurance documents. Families may also wish to retain funeral expenses and records showing the financial support provided by their loved one.
Tennessee generally has a one-year statute of limitations for wrongful death claims, although specific circumstances and legal exceptions may affect the deadline. Because this period can be short, families may benefit from seeking legal guidance promptly to understand their rights and avoid missing applicable deadlines.
