Memphis, TN (September 21, 2026) – A man died early Monday, September 21, after a crash on Jackson Avenue near Wales and Gragg. Memphis Police received the report at 1:30 a.m.
According to preliminary reports, it was apparently a pedestrian accident. The vehicle involved remained where the collision happened.
Once emergency services arrived, they pronounced the male deceased at the scene. Northbound and southbound lanes of Jackson Avenue were closed for a time, but the road has since reopened.
Investigators are still working to determine how the accident happened.
We extend our condolences to his family and loved ones.
After a fatal accident, Tennessee generally gives families one year from the date of a loved one's death to file a wrongful death lawsuit. That window can close faster than people expect, since the first weeks usually go to funeral plans, paperwork, and insurance calls.
Tennessee law generally lets the surviving spouse bring the claim, and if there is no spouse, the children or next of kin may pursue it. Depending on the circumstances, a personal representative of the estate may also be involved in filing.
In a wrongful death claim, recoverable damages can include funeral and burial costs, medical bills, the pain the person went through before death, lost income, and the loss of companionship family members relied on.
However, to know if a family can recover these damages, fault needs to be proved. Tennessee follows a modified comparative fault rule, so a claimant found equally or more at fault than the other party is generally barred from recovering, and smaller percentages reduce the award.
Evidence matters here, and camera footage or vehicle data may be overwritten or discarded within days. In these cases, a wrongful death lawyer can send preservation requests and help gather records while that material still exists.
