What Is the Statute of Limitations for a Crash in Knoxville, TN?

People injured in a crash in Knoxville, TN, generally have one year to file a personal injury lawsuit under Tennessee Code Annotated § 28-3-104. Tennessee law generally requires actions for injuries to a person to be commenced within one year after the cause of action accrues.

This deadline can apply to claims involving medical expenses, lost income, vehicle damage, pain and suffering, and other losses connected to a crash. Waiting beyond the applicable deadline can prevent an injured person from pursuing a lawsuit, although specific circumstances may affect when the limitation period begins or whether an exception applies.

After a Knoxville crash, injured people should preserve crash reports, medical records, photographs, insurance information, witness statements, vehicle repair records, and available video footage. Evidence showing vehicle positions, roadway conditions, traffic signals, and other circumstances surrounding the collision may also help document the claim.

Understanding Tennessee’s personal injury statute of limitations early can help ensure that a potential crash claim is evaluated before the one-year deadline expires. Certain circumstances involving criminal conduct may provide a different limitations period, so the specific facts should be reviewed when determining the applicable filing deadline.

A car accident attorney can help organize that documentation and explain how it may support a claim.
