The truck driver remained at the crash site and cooperated with investigators. Members of the department’s Traffic Reconstruction team examined the roadway and gathered information about the collision.

We extend our sincere condolences to the bicyclist’s family and loved ones.
In Jackson and throughout Tennessee, families generally have one year to file a wrongful death lawsuit after a fatal crash. The deadline usually depends on when the claim arose, which may not always be the date of death.
In certain situations, criminal charges and prosecution may extend the filing period to two years. However, specific legal requirements must be met, and an ongoing police investigation alone does not qualify a family for the extension.
Under Tennessee law, a surviving spouse generally has priority to bring a wrongful death claim. If there is no surviving spouse, children or next of kin may qualify. An estate representative may also file, subject to the applicable rules.
To establish what happened, crash reports and available video footage may help determine who was responsible for the collision. Medical records and financial documents can also help establish the losses resulting from the death.
Once the applicable deadline passes, a family may lose the right to pursue compensation through a wrongful death lawsuit. Filing requirements and possible exceptions should be reviewed before the deadline expires.
Because these deadlines can be difficult to determine, a wrongful death lawyer can review the circumstances and identify the applicable filing period. An attorney can also prepare the necessary paperwork and guide the family through the legal process.
