Yes. You can file a claim if your child was injured in a bus accident in Nashville. The claim may seek compensation for losses resulting from the child’s injuries.
When responsibility is determined, the bus driver, bus company, school district, or another driver may be legally responsible depending on how the collision occurred and the parties involved.
If the claim involves a public school district or another government agency, special Tennessee rules may apply. These cases can involve different filing requirements and limits on the compensation that may be recovered from a government entity.
Because Tennessee follows an at-fault insurance system, the responsible party’s insurer generally pays covered losses resulting from the crash. Health insurance may also help cover the child’s medical treatment while the injury claim is pending.
Once the child’s losses are established, compensation may include medical expenses, pain and suffering, future treatment costs, and other effects of the injuries. The amount available depends on the harm and losses caused by the accident.
While Tennessee generally gives minors additional time to bring certain personal injury claims, claims involving a government agency may follow stricter rules. Families should not assume the usual extension for a minor applies in the same way to every case.
During the claims process, a bus accident lawyer can review the crash report, determine which insurance may apply, and explain how a claim involving a minor works. An attorney can also communicate with insurers on your family’s behalf.
