According to the Tennessee Highway Patrol, the wreck took place at around 11:20 p.m. Medical crews transported one person to the hospital for further treatment of their injuries. The full scope of those injuries has not been disclosed by officials.
It is not clear the sequence of events that led to the wreck. Authorities continue to investigate.
We wish the injured person a strong and swift recovery.
In Tennessee, a person may still recover compensation after a motor vehicle injury even if they were partly at fault, as long as their share of the blame is less than 50 percent. Any award is reduced by that share. A person found 50 percent or more responsible is generally barred from recovering damages from the other driver.
The percentage matters more than many people realize. If a jury or insurer assigns a claimant 20 percent of the fault, for example, a $100,000 award would drop to $80,000. A common practice is that insurers try to argue for a higher share of blame to push a claim toward the 50 percent line.
Evidence tends to decide these percentages. Photos, medical records, witness statements, and dashcam or nearby business video, where it exists, can all show how each driver was traveling. A car accident lawyer in Knoxville can help identify which recordings and records exist, request them before they disappear, and explain how they may affect an insurer's fault argument.
Questions about how fault may be divided are best answered before an insurer settles the matter for you. At Fox & Farmer, we can review the evidence available and explain how Tennessee's 50 percent rule may apply to your accident.
