Tennessee law allows certain surviving family members to pursue a wrongful death claim when a person's death results from another party's wrongful act, neglect, or unlawful conduct. The state's wrongful death statute generally provides a specific order of priority for who may bring the action, beginning with the surviving spouse and then extending to other family members in circumstances established by law.
A wrongful death claim may seek damages for losses connected to the death, including medical expenses, funeral and burial costs, loss of earning capacity, and the loss of the person's companionship and society.
Tennessee law also permits certain damages related to the decedent's pain and suffering before death. The available damages depend on the facts and evidence that support the claim.
Time limits are also important. Tennessee generally applies a one-year statute of limitations to wrongful death actions, although the deadline can vary depending on the circumstances.
A fatal multi-vehicle crash can involve questions about several drivers' conduct, so preserving records, photographs, witness information, and other evidence early can be significant. A wrongful death lawyer can review the available evidence and explain which family members may have authority to pursue a wrongful death claim.
