Road Rage Crash Leaves Pedestrian Seriously Hurt on Rankin Ave in Dunlap, TN

September 15, 2026

Dunlap, TN (September 15, 2026) – A pedestrian was seriously hurt over the weekend after being struck by a vehicle near 14950 Rankin Avenue. The Dunlap Police said the wreck resulted from a road rage altercation. The call came in around 6:58 p.m. on Sunday, September 13.

Officers arrived and found the man hurt near the roadway. After speaking with several witnesses, police determined the collision followed an alleged road rage dispute. The man was treated at the scene before being taken to Erlanger Downtown for treatment.

The driver was taken into custody and charged with vehicular assault by reckless conduct.

Police say the investigation remains active and additional charges could follow.

Our thoughts are with the man as he continues to recover.

Can a Road Rage Victim in Dunlap, TN File a Civil Claim if Criminal Charges Are Filed?

Yes, a road rage victim in Dunlap can generally pursue a civil claim for compensation even while criminal charges move forward against the driver separately. Criminal and civil cases operate independently under Tennessee law, which means a conviction is not required before an injured person files a personal injury claim. In fact, evidence from a criminal case, including police findings and witness statements, tends to support a related civil claim.

When a crash results from reckless or intentional conduct rather than ordinary carelessness, Tennessee law also allows injured people to seek punitive damages in addition to standard compensation.

Punitive damages are meant to punish especially egregious behavior, and courts generally require clear and convincing evidence to support this type of award. Conduct tied to a road rage altercation can sometimes meet that higher standard depending on the specific facts involved.

A key aspect to take into account when it comes to filing a claim is Tennessee's one-year statute of limitations. The window is the same regardless of how long a related criminal case takes to resolve.

This timeline can create pressure to gather documentation early, especially since a criminal trial or plea process may extend well beyond that window. A pedestrian accident lawyer can help track these timelines and determine whether pursuing a civil claim alongside a criminal case makes sense.
