September 29, 2026

Germantown, TN (September 29, 2026) – A maintenance worker was found dead Monday, September 28, at Houston Levee Park in Germantown.

According to initial reports by the Germantown Police Department, the worker was doing maintenance when a piece of lawn equipment was involved. The body was found just before 3 p.m. behind Houston High School.

Investigators continue to look into what led to the worker's death.

We extend our condolences to the worker's family and coworkers.

Can Families Sue Beyond Workers' Comp After a Job Death in Germantown, TN?

Yes, in some situations. Tennessee workers' compensation generally limits claims against an employer, but the law also lets a family pursue a separate claim against a third party, such as a manufacturer or contractor, whose negligence or defective product contributed to a workplace death. Whether that applies depends on the facts, including who controlled the equipment and the worksite.

Workers' compensation still matters in these cases. It generally pays benefits to dependents and up to $10,000 toward funeral costs without anyone having to prove fault, but it typically does not cover every loss a family faces, such as loss of companionship.

A third-party claim can seek damages that workers' compensation does not, and the compensation insurer may hold a lien on part of any recovery. The two systems overlap, so sorting out how they fit together is typically where families need the most clarity.

Timing and proof drive these claims. Tennessee generally sets a one-year deadline for wrongful death lawsuits, and workers' compensation has its own notice requirements, including written notice to the employer within a set period.

Equipment involved in a workplace death can be repaired, sold, or returned to a rental company, so a wrongful death attorney can send a written preservation request early and help arrange an inspection.

If your family is dealing with a situation like this, you don’t have to do it alone. At Fox & Farmer, we can explain how a third-party claim may relate to benefits a family has already received.
